International family law describes the laws that apply to family law matters that include an international element. That element may be that a spouse, a partner, a spouse-to-be, or a child residing in another country. Or it may be that their assets or real estate property are in another country. Sometimes it can include a party that wishes to relocate to another country.

Maria Estela De Orduña is well versed in international family law treaties. We have practical experience in international family law matters including international custody.

Maria Estela De Orduña is a national of Mexico, and is licensed as an attorney in that country as well as California, and has practical experience as an attorney in Mexico and California, which is a critical element of her ability to counsel on cross-border family law matters.

Divorce

At De Orduna Family Law we understand that a divorce can be one of the most difficult things a person can ever experience. Our goal is to help you decrease the stresses involved. We will make sure everything is taken care of for you by walking you through the process step-by-step. Whether you are considering a divorce in San Diego or in the state of California, you will hear feedback from everyone around you. Your family, friends and neighbors will all have opinions based on what they have seen/experienced in the past. Mediation

Mediation is a way for divorcing couples to negotiate a resolution to their divorce or family law dispute without litigation which will drastically reduce attorney fees and costs. These disputes can be related to custody, division of assets, including complex cases involving business valuations, multiple assets and debts, spousal support and child support, or any other family law matter. A mediator is neutral. The couple will sit down with a neutral, third-party professional, usually an attorney who will listen to each person describe the problem as they see it and then help the two parties and their attorneys reach an agreement. Finally mediation is confidential. Anything that is said during the mediation process is confidential under California Evidence Code Section 1119(c). Any offers made by the couple in mediation, as well as anything said, cannot be used as evidence in court, nor can it be disclosed through the discovery process (California Evidence Code Section 1119 (a) & (b)).

Child Custody & Visitation

The question of who has custody over a child in the divorce is the most important, and emotionally distressing question you will ever have to deal with in the divorce process. The decision that is made during the divorce proceedings will determine the circumstances for your child for many years to come. We have decades of child custody experience that we put to work for you to fiercely protect their future. We will design a custody agreement that is innovative, creative, and above all, uphold your child’s best interests.

It is important to remember that although you may not like the other parent right now, your children love both of you. Learning to co-parent sooner than later will be the best thing you can do for your children during this process. While you are learning to cope with changes to parenting after your separation, remember that your children are also dealing with new changes and emotions.
